The petitioner apprehends her arrest in Gandhi Maidan P.S. Case No. 159/2012, registered for the offences punishable under Sections 409 and other Sections of the Indian Penal Code.

The informant, State Co-ordinator of Bihar Mahila Samkhya Society, made allegation that the NGO was working for the upliftment of poor girls and others and spent Rs. 20,71,141/- during the financial year 2006-2007 till 2010-2011. It is submitted that from perusal of FIR, it appears that the informant did not make any specific allegation against the petitioner Shyama Kumari. Shyama Kumari was appointed as a Warden of Kasturba Gandhi Balika Vidyalaya, Sahar on

Patna High Court Cr.Misc. No.43379 of 2015 (3) dt.22-12-2015 06.08.2011 after the financial year of 2010-2011. There is no audit report with regard to financial year 2011-2012. The amount of Rs. 20,71,141/- is said to have been embezzled during the financial year 2006-2007 till 2010-2011.

Considering the facts aforesaid, the petitioner above named in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Prabal Dutta, Judicial Magistrate 1st Class, Patna in connection with Gandhi Maidan P.S. Case No. 159/2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
