The petitioner has filed this petition for modification of the order dated 26.04.2019, passed in Cr. Misc. No.27523 of 2019 and to extend the period of surrender of the petitioner in the court below.

Learned counsel for the petitioner submits that the petitioner was granted anticipatory bail by order dated 26.04.2019, passed in Cr. Misc. No.27523 of 2019 but the petitioner could not surrender in the court below within four weeks from the date of receipt of the aforesaid order. It is further submitted that the petitioner contacted his learned lawyer

Patna High Court CR. MISC. No.42527 of 2019(2) dt.31-07-2019 2/2 appearing in the court below but he was not informed about the date of receipt of the order in the court below and that is why he could not surrender in time.

Having considered the facts aforesaid, the period of surrender of the petitioner is extended for two weeks from today. If the petitioner surrenders in the court below within two weeks from today, the learned court below shall enlarge the petitioner on bail on such terms and condition as laid down in the order dated 26.04.2019, passed in Cr. Misc. No.27523 of 2019.

The modification petition is allowed.
