1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 324, 307, 387, 504 and 34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 11.03.2024. It is next submitted that co-accused Dinesh Kumar had approaching this court seeking anticipatory bail by filing Cr. Misc. No.44587/2024 and the same was allowed by an order dated 29.07.2024. It is next submitted that allegation of assaulting the father of the informant i.e. deceased is against Rahul, who is alleged to have assaulted him by spade, causing

Patna High Court CR. MISC. No.48441 of 2024(3) dt.05-10-2024 2/2 injury on head and this petitioner is alleged to have assaulted his father by lathi causing abrasion on hand. It is next submitted that the father of the informant died during the course of treatment after 9 days of the occurrence. It is also submitted that the postmortem report of the deceased was perused in Cr. Misc. No.44587/2024 and the same recorded that injury on the toe is in the nature of abrasion and same has been caused by hard and blunt substance. It is also submitted that postmortem report also record that the injury on elbow is in nature of abrasion.

4. Learned A.P.P. opposes the prayer for bail of the petitioner.

5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Turkauliya P.S. Case No.1239/2023.
