2. Petitioner apprehends their arrest in a case registered for the offence punishable under sections 137 ( 2 ), 96 and 3(5) of BNS.
3 . As per the prosecution case , informant namely
Patna High Court CR. MISC. No.48921 of 2025(2) dt.31-07-2025 2/3 Vinod Paswan alleged that on 13.03.2025 , her daughter went missing. During search , informant learned that all the accused persons including these petitioners kidnapped her daughter for the purpose of marriage .
4. It is submitted on behalf of the petitioners that petitioners are innocent and have committed no offence as alleged. Petitioners have been made accused in this case merely because they happens to be relative of co-accused Pradeep Manjhi. It is further submitted that victim in her statement recorded under section 183 BNSS has stated that she on her own will left the house and went to co-accused Pradeep Manjhi and solemnized marriage with him. So far as these petitioners are concerned, they have got no concern with the aforesaid occurrence . Petitioner claims clean antecedent. 5 . Learned counsel for the State oppose the bail petition .
6 Considering the statement of the victim recorded under section 183 BNSS, and also the fact that there is no allegation against these petitioner who are relatives of coaccused Pradeep Manjhi , clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as
Patna High Court CR. MISC. No.48921 of 2025(2) dt.31-07-2025 3/3 named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class Araria in connection with Palasi P.S. Case No. 102 of 2025 , subject to the conditions laid down under section 482 ( 2 ) of BNSS 2023 .
