The petitioner is in custody in connection with Suiya P.S.Case No.17 of 2019 pending in the Court of learned ACJMIst, Banka registered for an offence under Sections 341, 324, 302 and 34 of the Indian Penal Code .

As per prosecution case, the petitioner and other coaccused persons stabbed the informant's husband on his left eye by means of knife and Khanti and thereafter all the accused persons including the petitioner fled away from the place of occurrence. During course of treatment, informant's husband died in the hospital.

In view of the specific allegation of assault by means of Khanti in the left eye of the deceased, causing injury of the
