JUSTICE SHIVAJI PANDEY ORAL ORDER 11-02-2015 Heard learned counsel for the petitioner and the State. Earlier this Court has rejected the bail prayer of the petitioner in connection with Shastri Nagar P.S.Case No. 174 of 2013 registered u/s 365 IPC.

This Court had called for the DNA report and the CDR of the victim vis-à-vis the petitioner. From the report of the Deputy Superintendent of Police, Secretariat, Patna it appears that there is no DNA Report of deceased comparing with his mother. The CDR has been received which speaks volumes about the petitioner.

This Court does not wand to give any positive finding in this proceeding . Accordingly this petition is dismissed. However, the trial court is directed to expedite the

Patna High Court Cr.Misc. No.23679 of 2014 (6) dt.11-02-2015 2/2 trial and conclude the same as soon as possible, preferably within a period of nine months from the date of receipt/production of copy of this order.
