Learned counsel for the petitioner is expected to honor his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by office when called upon.

The petitioner seeks bail in Mohania PS Case No.141 of 2020 instituted for the offence under Section 392 of the Indian Penal Code.

Three persons riding on a motorcycle have allegedly snatched the bag containing cash, mobile phone and some other documents from the informant.

Petitioner's counsel submits that the petitioner's name has surfaced because in investigation it was found that he had talked to co-accused Mintu Gaddi on his mobile phone six times. The location of the mobile phone of the said co-accused was found near the place of occurrence. The petitioner and six others have

Patna High Court CR. MISC. No.362 of 2021(2) dt.22-02-2021 2/2 been arrested. It is submitted by the petitioner's counsel that the co-accused Mintu Gaddi, Mohd. Jasimuddin and Md. Rizwan @ Babu have already been allowed bail in Cr Misc Nos 30789 of 2020, 35229 of 2020 and 25303 of 2020. The investigation is complete. The petitioner is on bail in the other three cases pending against him. In this case, he is in custody since 02.06. 2020. He has not been put on Test Identification Parade. The learned APP for the State has opposed the prayer for bail.

Considering the rival submissions, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Kaimur at Bhabua, in connection with Mohania PS Case No.141 of 2020, GR No 873 of 2020, subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
