2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018 registered in connection with Ramgarh (Nuaon) P.S.Case No. 194 of 2024.

3. As per allegation, the police on a secret information regarding transportation of illicit liquor in a car, reached the informed place and searched the vehicle, wherefrom 428.160 litres of illicit liquor was recovered.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and the entire allegation is false

Patna High Court CR. MISC. No.48863 of 2024(3) dt.11-09-2024 2/2 and fabricated. He has submitted further that the wife of the petitioner is suffering from cancer and is in critical stage. The petitioner is a person of clean antecedents and is lodged in prison since 12.06.2024.

5. Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court No.1, Kaimur at Bhabua in connection with Ramgarh (Nuaon) P.S.Case No. 194 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
