JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-07-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Sherghati P.S. Case No. 678 of 2018 for the offenses under Sections 379, 511 and 401 of the Indian Penal Code. The allegation against the petitioner is that he was involved in committing theft in ATM of HDFC Bank by cutting the same by Gas Cutter.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is in custody since 25.12.2018.

Considering the fact that the petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail
