JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-01-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 385, 386, 387 of the Indian Penal Code.
As per the prosecution case, FIR named two accused persons, Madho Singh and Satish Pandey, were apprehended who allegedly threatened the informant to withdraw the case filed against this petitioner and they disclosed that they are members of PLFI and and work under this petitioner. Learned counsel appearing for the petitioner submits that petitioner has been made accused only on the basis of confessional statement of co-accused, who were apprehended on the spot. No extortion money was demanded by this petitioner and apprehended co-accused have already been granted bail by
Patna High Court CR. MISC. No.2815 of 2021(8) dt.03-01-2022 2/2 the court below. Petitioner is in custody since 03.06.2020 and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail and submits that petitioner is accused in as many as 26 criminal cases registered under various Sections of the IPC and CLA Act at different police stations. The petitioner is one of the activists of PLFI and is involved in criminal activities and extortion.
Considering the nature of accusation, gravity of the offence and criminal antecedent of the petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
