The petitioner seeks bail in Special case no. 136 of 2017, arising out of F. No. NCB/ PZU/V/17/2017 instituted for the offence under Section(s) 8©,20(b)(ii)(c) of N.D.P.S. Act. It is alleged in the written report that a truck was intercepted after getting information from N.C.B.Patna Zonal unit, about smuggling of Ganja. The said truck was searched and 300 kg of dried brown colour substance believed to be Ganja packed and wrapped in 30 brown colour packets were recovered from the said truck.

The petitioner was driver of the aforesaid truck. The petitioner has confessed that he is involved in trafficking of said

Patna High Court CR. MISC. No.45286 of 2019(4) dt.28-08-2019 2/2 Ganja. Thereafter, Ganja was seized and seizure list was prepared. Earlier, the prayer for bail of the petitioner was rejected by this Court vide order passed in Cr. Misc. no. 31336 of 2018 with direction to trial Court to expedite the trial. Report called for from the court below has been received from which it appears that charge has already been framed in this case on 28.5.2019 and the case is fixed for evidence. Trial court has mentioned in the report that trial is likely to be concluded within a period of 08 months.

Therefore, this Court does not find any fresh ground for grant bail to the petitioner. The prayer for bail of the petitioner stands rejected at this stage.

Trial Court is directed to expedite the trial and make efforts to conclude the same as early as possible preferably within a period of nine months from the date of receipt of copy of this order and send compliance report.

Petitioner may renew his prayer for bail in the event trial is not concluded within the aforesaid period. (Sanjay Priya, J) shyambihari/- U T
