2. The petitioner is in custody in connection with Dariyapur P.S. Case No. 227 of 2023 for the offence under Sections 366A, 34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 10.05.2023.

4. As per prosecution case, the petitioner and his father are said to have taken away the minor victim girl.

5. The statement of the minor victim girl was recorded under Section 164 of the Cr.P.C in her statement she stated that she is the friend of petitioner and out of her own free will going to Himachal tour with him.

6. Considering the aforesaid facts and period of

No.46238 of 2023(2) dt.04-08-2023 2/2 custody, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-13th, Saran at Chapara in connection with Dariyapur P.S.
