The petitioner apprehends his arrest in connection with Sathi P.S. Case No. 23 of 2017 registered under Sections 406 and 420 of the Indian Penal Code.
The accusation is that informant, Ranjan Kumar, and other students of Rajkumar Sukla College filled up the form for appearing in the examination on the instruction of Principal of Rames Jee, Bashishtha Kuer (petitioner), Ganesh Jee Stawaria and Nasim Chanpatiya, while the date of examination is scheduled on 14.02.2017 but admit cards are not issued.
Patna High Court Cr.Misc. No.21504 of 2017 (4) dt.16-10-2017 Learned counsel for the petitioner submits that admittedly the petitioner was the Principal of Rajkumar Sukla College, but he was removed from there on 15.01.2016 and at the time of filling up the application forms for appearing in the examination scheduled to be held on 14.02.2017, the petitioner was not the principal of that college. In fact, at that time, Ramesh Jee was the principal of Rajkumar Sukla College. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran, in connection with Sathi P.S. Case No. 23 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
