Heard the learned counsel for the petitioners.
This review application has been filed praying for review of the order dated 03.09.2014 passed in CWJC No.8956/2013. The learned counsel for the petitioners has pointed out that the aforesaid order was earlier assailed in L.P.A.No.80/2015 but later on the appellants in the said appeal sought permission of the Court to withdraw the appeal with liberty to file a petition for review, in future, if so advised, and also to take recourse to such provisions of law as may be permissible. The present review application has been filed thereafter.
During the course of submission in response to the query of this Court regarding the error apparent on the face of the record or any other sufficient reason warranting review of the aforesaid order, the learned counsel for the petitioners has fairly submitted that there is no apparent error on the face of the record or any sufficient reason but has only prayed for some observation of this Court with regard to the passing of the order by the respondents in pursuance to the direction as contained in the aforesaid order under review. The learned counsel for the petitioners however has also accepted that the relevant circulars issued by the review petitioners were not brought to the notice of this Court by the review petitioners, during the course of hearing of the writ application and when the order dated 03.09.2014 in CWJC No.8956/2013 was passed.
After considering the aforesaid facts and circumstances as well as the submissions on behalf of the petitioners, this Court finds that there is no apparent error on the face of the record or any other sufficient reason warranting review of the order as prayed. This Court, in this backdrop, also concludes that there is no scope for passing observation as prayed.
The review application is, accordingly, dismissed.
