2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.
3. It is alleged that 19.27 liters of country made liquor is recovered from bush near the house of petitioner.
4. It is submitted that no incriminating article has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. It is further alleged that at the time of filing of this this instant FIR, petitioner has got no criminal antecedent and subsequently, petitioner has falsely been implicated in Bhagwan Bazar Police Station Case No.523 of 2022 dated 10.11.2022 under Section
Patna High Court CR. MISC. No.45866 of 2023(3) dt.17-08-2023 2/2 30(a) of Bihar Prohibition and Excise Act in which he has got anticipatory bail.
5. Learned counsel for the State opposes the bail petition.
6. Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Exclusive Special Excise Judge, Saran at Chapra, in connection with Rivilganj Police Station Case No.238 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
