The present petition has been preferred for quashing of the order dated 23.04.2014 passed by learned S.D.J.M. Birpur in connection with Birpur P.S. Case No. 205/2013 whereby cognizance has been taken under Sections 341, 323, 324, 325, 307, 504, 506 and 34 of the I.P.C.

As per the prosecution story, the informant has alleged that the accused persons were filling up his land and when objected, he was assaulted by 'rod'. When his family members came to his rescue, they too were assaulted. The further allegation is of putting 'chilly' powder in his eyes. Accordingly, the F.I.R.

No.46212 of 2015(2) dt.15-03-2023 2/2 The learned S.D.J.M. took up the matter on 23.04.2014 and passed order taking cognizance in the case prompting the petitioner to prefer present petition. Having gone through the case, this Court does not find it to be a fit case for interference and as such the petition stands dismissed.
