Heard learned counsel for the petitioner, opposite party No. 2 and learned APP for the State.

The petitioner is apprehending his arrest in a case registered under Sections 341, 323, 307, 379, 427, 436/34 of the Indian Penal Code.

Earlier prayer for anticipatory bail of the petitioner was rejected by this Court vide order dated 03-10-2017 passed in Cr. Misc. No. 45595 of 2017. A compromise petition has been brought on record by way of filing supplementary affidavit.

Patna High Court Cr.Misc. No.43077 of 2018 (4) dt.19-09-2018 Counsel for opposite party No. 2 is present in the court. He supports the contention made on behalf of the counsel for the petitioner. He does not challenge the compromise entered between the parties.

Considering the fact that the matter has been settled between the parties, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned learned Additional Chief Judicial Magistrate-Ist, Hilsa, Nalanda in connection with Khudaganj P.S. Case No. 75 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
