The petitioner is languishing in custody since 20.12.2013 in a case registered for the offences punishable under Sections 307 of the Indian Penal Code and 25(1-B)a, 26 and 35 of the Arms Act.

It is alleged that when the police raided the house of the petitioner then the police resorted to firing, though, no injury was caused to the police force, but from the possession of petitioner two country made pistols, eight live cartridges, four empty cartridges, one wallet and one mobile were recovered.

It is submitted by learned counsel for the

No.24277 of 2014 (04) dt.08-01-2015 2/2 petitioner that the FIR suggests that the recovery was made from the possession of the petitioner where it was recovered from the joint family house of the petitioner. Though, petitioner is accused in nine other cases, but he is on bail in six cases. Considering the period under custody, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ad hoc Additional Sessions Judge 2nd, Khagaria in connection with S.C. No. 137 of 2014 arising out of Parbatta P.S. Case No. 293 of 2013. The learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
