The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 498A, 323, 504, 307, 468 and 494/34 of the Indian Penal Code. Petitioner is husband of informant Sarwari Saba. Marriage was solemnized in the year 2004. Thereafter there is allegation of torture for different reasons including demand of dowry and solemnization of marriage with another lady. During pendency of this case, the victim already died on 04.03.2016 due to tuberculosis as submitted by learned counsel for the petitioner on the basis of report in the case diary. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty
Patna High Court Cr.Misc. No.22423 of 2017 (4) dt.11-07-2017 2/2 days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna/successor Court in connection with Mahila Police Station Case No. 01 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
