1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The learned counsel for the petitioner submits that present quashing application seeking quashing of the order dated 22.08.2015, passed by the learned Judicial Magistrate, 1st Class in connection with Mokama P.S. Case No. 242 of 2013 whereby cognizance has been taken under Sections 147, 148, 149, 341, 323, 504 and 109 of the Indian Penal Code. The learned counsel submits no doubt much water has been flown from the date of taking cognizance and presently does not have instruction with regard to the stage of the case and thus seeks permission to withdraw the present quashing application with

Patna High Court CR. MISC. No. 49715 of 2015(2) dt.29-08-2023 2/2 liberty to raise all the issues at the time of framing of charge, if not framed.
