JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-06-2017 Heard learned counsel for the petitioner and learned APP representing the State.

Petitioner apprehends his arrest in connection with Town (Darbhanga) P.S. Case No. 136 of 2916 registered for the offences punishable under Sections 420, 379, 414/34 of the Indian Penal Code.

Allegedly, the petitioner being C.I. in Pace Power being in collusion and conspiracy with the driver of the pick-up van and others used to steal diesel and used to mix kerosene oil. Submission is of false implication and that the petitioner has not been apprehended on the spot, only due to professional rivalry the petitioner has been implicated in this case by the informant who is not authorized to lodge this case, nothing has been found against the petitioner and as such he deserves

Learned APP opposes the prayer of pre-arrest bail of the petitioner.

In the facts and circumstances stated above, considering that the petitioner has not been apprehended on the spot, the petitioner above named, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Town P.S. Case No. 136 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
