2. The petitioner is apprehending his arrest in connection with Ahiyapur P.S. case No. 1260 of 2023 registered under Sections 302 and 120(B) of the Indian Penal Code.

3. The prosecution allegation, in short, is that on the alleged date and time of occurrence, the accused persons including the petitioner killed the informant's brother-in-law by slitting his throat after hatching conspiracy.

4. It has been submitted on behalf of the petitioner that the petitioner is innocent and has falsely been implicated in this case. The petitioner has got one criminal antecedent in which he is on bail. No specific allegation is attributed against the

Patna High Court CR. MISC. No.49643 of 2024(3) dt.09-08-2024 2/2 petitioner. General and omnibus allegation has been made against the petitioner. There is subsisting land dispute between the parties. In course of investigation, nothing adverse has come against the petitioner implicating him in the alleged occurrence. Co-accused have been granted regular bail by this Court vide Annexure-P/4 series.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Court below/concerned Court in connection with Ahiyapur P.S. case No. 1260 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
