JUSTICE SUDHIR SINGH ORAL ORDER 08-02-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in connection with RPF/ POST/ Jasidih P.S.Case No.02 of 2015 instituted under Sections 3(a) of RP (UP) Act, 1966, pending in the court of learned Railway Judicial Magistrate, Kiul, District- Lakhisarai. It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. There is no recovery from the conscious possession of the petitioner and no offence is made out under Section 3(a) of RP (UP) Act. On behalf of the State, it is submitted that the petitioner is named in the FIR. There is one more case of similar nature against him.

Considering the aforesaid facts, I am not inclined to

Patna High Court Cr.Misc. No.49357 of 2015 (3) dt.08-02-2016 2/2 grant anticipatory bail to the petitioner and same is rejected. Any how, if the petitioner surrenders in the court below and pray for regular bail, same shall be considered on its own merit without being prejudiced by this order of rejection.
