Learned counsel for the petitioner submits that during pendency of this case, the petitioner's son has also filed the petition before the learned Trial Court seeking permission for sale of the joint family property in order to meet his educational expenses but, the same has been rejected by the learned Trial Court vide order dated 22.09.2022. The present petition has been filed against the rejection of the permission sought by the petitioner to sell the joint family property in order to meet the educational expenses of his son.

In the aforesaid circumstances, learned counsel for the petitioner seeks permission to withdraw this application with liberty that his son be permitted to challenge the order dated

Patna High Court C.Misc. No.1428 of 2016(14) dt.14-11-2022 3/3 22.9.2022 before this Court and the withdrawal of the petition may not come in the way of challenge on behalf of the son of the petitioner.

Permission is granted.

Accordingly, this application is dismissed as withdrawn with aforesaid liberty.
