The petitioner is apprehending his arrest in connection with Barauli (Madhopur O.P.) P.S. Case No.61 of 2015 for the offences instituted under Sections 341, 323, 307, 379, 504 and 354(A)/34 of the Indian Penal Code.
The prosecution story, in brief, is that on the date and time of the occurrence when the informant reached to him all the accused persons including the petitioner started to assault by fists and leg to the wife and daughter and also abusing them, then the informant asked them why are beating to my wife and daughter, then all the accused persons assaulted him by bricks on his mouth and head, in the meantime accused Rajan Kumar and Dhananjay
Patna High Court Cr.Misc. No.48661 of 2015 (2) dt.05-02-2016 2/2 Kumar came and assaulted him by fists and slaps and accused Mananjay taken away Rs.1,500/- from the pocket of the informant. It is submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. Petitioner is the lady. Both the parties are agnates. The alleged occurrence is said to have taken place due to petty reason. No specific injury has been attributed. Vide Annexure-2, the matter has been compromised between the parties.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Barauli (Madhopur O.P.) P.S. Case No.61 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
