JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307 and 507/34 of the Indian Penal Code.
The prosecution case is that Bhagwan Gee Bhagat, Rajesh Bhagat and the petitioner came and made assault to the informant with lathi and farsa and when the wife, son and daughter of the informant came to rescue they were also assaulted by other accused persons.
It is submitted by learned counsel for the petitioner that in the background of land dispute, the accusation has been levelled. The informant alleged to have been assaulted by three persons when he received only two injuries, one by sharp cutting
Patna High Court Cr.Misc. No.55654 of 2015 (2) dt.08-12-2015 2/2 weapon and other by hard and blunt substance. Both injuries have been found to be simple in nature. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan in connection with Mairwa P.S. Case No. 107 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
