JUSTICE SANJAY PRIYA ORAL ORDER 3/ 09-08-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Thawe P.S. Case No.10 of 2018 instituted for the offence under Section(s) 366(A)/34 of the Indian Penal Code.

It is alleged in the written report that minor daughter of the informant has been kidnapped by the petitioner. She had gone to take water but she did not return.

Case diary has been received.

The victim girl on her recovery has given statement under Section 164 Cr. P.C which is available in the case diary wherein she has stated her age as 14 years and the court has assessed her age to be 16 years. She has levelled specific allegation against the petitioner of kidnapping and committing illegal act with her after confining her in a hotel room in

Patna High Court Cr.Misc. No.43745 of 2018 (3) dt.09-08-2018 2/2 Gopalganj. He also made video and took her naked photograph. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail.
