JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 18-03-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceeding. Learned counsel for the petitioner undertakes to remove the defects within four weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioner seeks bail in connection with Kumarkhand P.S. Case No.27/2020 registered for the offence punishable under Sections 25(I-B)a, 26 of the Arms Act.
As per the prosecution case, the police party made raid in the house of the petitioner and recovered pistol, one live cartridge and one mobile.

No.3777 of 2021(2) dt.18-03-2021 2/2 It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case and has not committed any offence. No incriminating article has been recovered from his conscious physical possession rather it is a manipulation with collusion of the police. The allegation leveled against the petitioner is false and manufactured by the police. Co-accused namely Sonu Kumar @Suman Kumar has already been granted bail by a co-ordinate Bench of this Hon'ble Court vide order dated 09.11.2020 passed in Cr. Misc. No.25470 of 2020. The petitioner has one criminal antecedent and has been languishing in custody since 08.02.2020.
Learned APP for the State opposed the bail petition. Considering the period of custody, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below in connection with Kumarkhand P.S. Case No.27/2020.
