The Petitioners apprehend their arrest in Lakhisarai Mahila P.S. Case No. 35 of 2013 registered for the offences punishable under Sections 498A, 406, 354/34 of the Indian Penal Code and Sections 3/4 of the D.P. Act and Sections 4/12/31 of the Domestic Women Violence Act.
Learned counsel for the petitioners submits that the petitioner no. 1 is the Jethani and petitioner no. 2 is the Jaut of the husband of the informant. They are innocent and have not committed any act of cruelty. However, the husband of the
Patna High Court Cr.Misc. No.22518 of 2017 (2) dt.31-05-2017 2/2 informant has been granted bail by a co-ordinate bench of this Court vide order dated 13.01.2015 in Criminal Miscellaneous No. 1268 of 2015.
Considering the aforesaid facts and circumstances of the case, let the petitioners named above in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai Mahila P.S. Case No. 35 of 2013; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973. (S. Kumar, J) Ranjan/- U
