JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 08-08-2022 Heard learned senior counsel for the petitioner, learned counsel for the O.P. No.2 and learned APP for the State. Learned counsel for the petitioner undertakes to remove the defects within four weeks of resumption of normal court proceedings. In the eventuality of non-removal of defects within stipulated period, office will place the matter before the Bench. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 406, 420, 467, 468, 471, 120(B), 34 of the IPC.
Vide order dated 22.07.2021, petitioner was granted anticipatory bail by a co-ordinate Bench of this Court.
Patna High Court CR. MISC. No.2812 of 2021(10) dt.08-08-2022 2/2 Learned senior counsel for the petitioner has given a Bank draft of Rs.4,00,000.00/- (Rupess Four Lakhs) of ICICI Bank, Demand Draft No.503075 to the learned counsel for the O.P. No.2 in the Court today. The said draft has been handed over to the counsel for the O.P. No.2.
It is submitted by learned senior counsel for the petitioner that the rest amount of Rs.4,00,000/- (Rupees Four Lakhs) shall be paid by March, 2023.
Considering the same, the provisional bail granted to the petitioner vide order dated 22.07.2021, in connection with Laheriasarai P.S. Case No.484 of 2019, is hereby confirmed, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
However, if the said amount i.e. Rs.4,00,000/- (Rupees Four Lakhs) is not paid by March, 2023, the O.P. No.2 is at liberty to file for cancellation of bail, before the learned court below.
It is made clear that after payment of the entire amount by the petitioner, the O.P. No.2 will withdraw all the criminal cases filed against the petitioner.
