JUSTICE ANIL KUMAR SINHA ORAL ORDER 16-11-2022 The petitioner has filed a suit for eviction against the respondent on the ground of personal necessity bearing Title Suit No. 10 of 2017 pending before the learned Munsif, Danapur.
Mr. Saket Tiwary, learned counsel for the petitioner submits that since the suit is for eviction on the ground of personal necessity and the same is pending for the last almost five years, accordingly, a direction may be issued to the learned Munsif, Danapur, to decide the Eviction Suit on its merit within a reasonable time frame.
Section 14 (7) prescribes that the Court while hearing the suit under Section 14 of the Bihar Buildings (Lease, Rent & Eviction) Control Act, 1982, shall follow the practice
Patna High Court C.Misc. No.533 of 2022(2) dt.16-11-2022 2/2 and procedure of a court of small causes including the recording of evidence.
Taking into consideration the fact that the suit is for eviction on the ground of personal necessity, I direct the learned Munsif, Danapur, to dispose the suit in accordance with law expeditiously, preferably within a period of six months from the date of receipt/production of a copy of this order.
