JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 14-07-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioner apprehends her arrest in connection with Brahampur P.S. Case No. 83 of 2017 for the offences punishable under sections 419, 420, 467, 468 and 471/34 of the I.P.C.
Allegedly, the petitioner on the basis of the forged T.E.T certificate got appointment on the post of Block Teacher and accordingly service has been terminated and it has been ordered to lodge FIR.
Submission is of false implication and that the petitioner has given valid certificate of Bihar Elementary Teacher
Patna High Court Cr.Misc. No.22509 of 2017 (3) dt.14-07-2017 2/2 Eligibility Test (BETET), 2011 which is annexed as Annexure-2 to the supplementary affidavit, no forgery was committed, the petitioner has filed C.W.J.C. No. 1155 of 2017 before the Hon'ble Court which is still pending for due consideration, the petitioner is the law abiding citizen and has got full respect in the process of law, for realizing the salary from the petitioner certificate case ought to have been lodged but the FIR has been lodged only with a view to harass the petitioner.
The learned A.P.P. submits that the petitioner ought to have filed certificate before the competent authority for its verification.
In the facts and circumstances as stated above, considering that the petitioner is lady and as such she, in case of her arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Buxar in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) Abhay/- U T
