Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379/34 of the Indian Penal Code. It is alleged that petitioner assaulted with sickle on the head of the informant. When the brother of the informant came to rescue, then Rajeshwar Ram made attempt to gave spade blow to him, but Shrawan Kumar Mahto caught the spade, as a result he himself sustained injury. The co-accused Sanful Ram took out gold chain from the informant. It is submitted by the learned counsel for the petitioner that for the occurrence of 07.07.2015 the First Information Report was registered on 09.07.2015. There is counter version of the occurrence. The case lodged by the
Patna High Court Cr.Misc. No.48143 of 2015 (2) dt.05-11-2015 petitioner's side was at the earlier point of time, whereas the injury of the informant on the left side of forehead has been found to be simple in nature.
The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Khanpur P.S. Case No. 98 of 2015, pending in the court of learned SubDivisional Judicial Magistrate, Samastipur. With this observation this application is disposed of.
