The petitioner seeks anticipatory bail in connection with Laxmipur P.S. Case No. 98 of 2017, registered for offences punishable under Sections121 (A), 122, 120 (b), 427, 431 of the Indian Penal Code and under Sections 16,17, 18,19,20 and 21 of U.A.P. Act.

As per F.I.R., allegation against the petitioner is that some Maoist Naxalities set fire in Mobile Tower of Anandpur village, causing damage.

Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case and nothing has been attributed against the petitioner and moreover, other accused has been granted bail by a Co-ordinate Bench of

Patna High Court Cr.Misc. No.44086 of 2018 (3) dt.31-07-2018 2/2 this Court vide order dated 18.06.2018 passed in Cr. Misc. no.33409 of 2018.

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, surrenders be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- III, Jamui in connection with Laxmipur P.S.Case No. 98 of 2017, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
