2. The petitioner apprehends his arrest in connection with Bihta P.S. Case No. 283 of 2025 registered for the offence under Sections 190, 127(1), 127(2), 115(2), 118(1), 109, 303(2), 191(2), 191(3) of the BNS and under Sections 27, 25(1-B)A, 26, 35 of the Arms Act.

3. As per the prosecution case, the petitioner is accused of assaulting the informant on his head by butt of the pistol.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in this case. He further submits that there is case and counter case also and injury is on both the sides.

5. Though, the doctor has reported that the victim has sustained grievous injury but from perusal of the injury report, it appears that the injuries sustained by the victim are simple in nature.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the concerned Court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-II, Danapur/concerned Court below in connection with Bihta P.S. Case No. 283 of 2025, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482 of the BNSS.
