Petitioners are apprehending their arrest in connection with a case registered for the offences under Section 304-B and other allied Section of the Penal Code. They are inlaws and named in the First Information Report along with their son. Son has already surrendered in the court below. It is submitted on behalf of the petitioners that the informant, who is the brother of the deceased, has himself realized later that his sister died because of ailment and was not killed and having understood such fact he filed petition in the court below. Let petitioners and the informant appear before the court below within a period of four weeks from the date of
Patna High Court Cr.Misc. No.48170 of 2015 (2) dt.02-11-2015 2/2 receipt/ production of a copy of this order in the court below and if the informant accepts that he has filed petition stating that he has later realized that his sister died because of ailment and not because of being killed, petitioners, above named, be released on bail on furnishing bail bonds of Rs. 5,000/-(Rs. Five Thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Ist Class, Gaya in connection with Tekari P.S. Case No. 228/2015, subject to the conditions laid down under Section 438(2) Cr.P.C. and informant should be one of the bailors. This petition is, accordingly, disposed of.
