2. Notice was validly served upon opposite party no. 2 but no body appeared on her behalf.
2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 323, 324, 379, 384/34, 498A of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.
3. There is allegation against the petitioner is that he demanded Rs 7 lakh as dowry.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this

The petitioner is ready to keep the complainant with honour and dignity but the complainant does not want to live with the petitioner. They filed mutual Divorce petition vide Divorce Case no. 82 of 2020 dated 04.09.2020 before Principal Judge cum Family Court Saran at Chapra, which is pending before the court below. He further submitted that opposite party no. 2 is working as a government teacher.
5. Learned APP for the State opposed the prayer for bail .

Considering the facts and circumstance of the case, let the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Complaint Case No. 3346 of 2021 subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
