JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-09-2017 Heard learned counsel for the petitioner, learned counsel appearing on behalf of O.P. No.2 and the learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Compliant Case No.294 (C) of 2016, registered under Section 498(A) of the Indian Penal Code.

The accusation is of torturing and harassment of the complainant/O.P. No.2 by her husband and other in-laws due to nonfulfillment of demand of dowry and removing her along with child from the matrimonial house after snatching her personal belongings. Learned counsel for the petitioner submits that on the joint prayer of the parties, the matter was referred to the Mediation Centre, Patna High Court, Patna for settlement of dispute between the

Patna High Court Cr.Misc. No.22464 of 2017 (5) dt.14-09-2017 2/2 petitioner and O.P. No.2, who are husband and wife, where the matter was settled and, accordingly, petitioner accompanied his wife O.P. No.2 and started to live together and yesterday both came, thereafter, the O.P. No.2 was accompanied by her mother.

On the other hand, learned counsel appearing on behalf of O.P. No.2 submits that, in fact, both petitioner and O.P. No.2 came together, but petitioner left her at Dakbangala roundabout, thereafter, she stayed at railway station.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Sikrahana at Dhaka, East Champaran in connection with Compliant Case No. 294 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
