====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 26-07-2019 Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273, 120(B) of the Indian Penal Code and Sections 30(A), 38(i)(ii) of the Bihar Prohibition and Excise Act, 2016.
Allegation is that from a truck liquor was being unloaded by the named persons including the petitioner. The petitioner was identified by the Chaukidar as a person who had fled away seeing the police party. Petitioner has got an identical criminal antecedent.
Submission is that there is no direct or indirect involvement of the petitioner in this case. Only suspicion is there against the petitioner.
Considering the aforesaid facts, let the petitioner,
Patna High Court CR. MISC. No.46339 of 2019(2) dt.26-07-2019 2/2 above named, be released on bail if the trial is not concluded within a period of six months from the date of framing of charges against the petitioner on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Hathauri Police Station Case No. 67 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
