JUSTICE SATYAVRAT VERMA ORAL ORDER 23-02-2022 Heard learned counsel for the petitioner and Dr. Kumar Uday Pratap, learned A.P.P. for the State. The petitioner seeks bail in connection with Yogapatti P.S. Case No. 126 of 2021 instituted for the offences under Sections 413 and 414 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 21.03.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the informant alleges that the petitioner was apprehended with a stolen motorcycle.

Learned counsel for the petitioner submits that the petitioner was completely unaware that the motorcycle was stolen one as he had taken the motorcycle from his friend

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 21.03.2021, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran in connection with Yogapatti P.S. Case No. 126 of 2021.
