====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-07-2025 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 117(2), 118(2), 109(1), 74, 76, 351(2), 352 of the Bharatiya Nyaya Sanhita.
3. Informant, namely, Chandrakant Sinha alleged that on 26.03.2025 when informant was constructing his house, all the F.I.R. named accused persons, including these petitioners, came there and started abusing and assaulting him and his family members by means of lathi, danda, bricks, etc.
4. Learned counsel for the petitioners submits that due to land dispute, an altercation took place between the parties.
Patna High Court CR. MISC. No.45615 of 2025(2) dt.28-07-2025 2/2 Allegation of assault is general and omnibus and there is no specific allegation of overt act against these petitioners. It is further submitted that though there is allegation that petitioner no. 1 along with two others assaulted on the head of the son of informant but doctor has found only one head injury. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Kishanganj in connection with Dighalbank P. S. Case No. 64 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
