KUMAR ORAL ORDER 31-05-2017 Heard learned counsel for the petitioner and the State. Petitioners are apprehending their arrest in Kesariya P.S. Case no. 120 of 2014 for the offences registered under Sections 448, 341, 323, 379, 376, 511, 504 and 506/34 of the Indian Penal Code.

It is alleged that petitioners made an attempt to outrage modesty of the informant but could not succeed. On hearing noise they fled away snatching one gold chain of the informant.

It has been contended on behalf of the petitioners that they have got no criminal antecedent. A dispute is going on between the parties with regard to a jackfruit tree as both the parties

Patna High Court Cr.Misc. No.22437 of 2017 (2) dt.31-05-2017 2/2 are claiming the tree of their own and for the said reason this case has been filed. Petitioners are respectable persons of the society. Considering the facts and circumstances of the present case, let petitioners, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Motihari, in Kesariya P.S. Case no. 120 of 2014 ( G. R. case no.2677 of 2014), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (S. Kumar, J) sudip/- U T
