====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 26-07-2021 Heard the parties in virtual court proceeding. Learned counsel for the petitioner informs that in para 1 of the bail petition, Section 392 of the I.P.C. has been left to be typed and it should be read as Section 392 of the I.P.C. and Sections 25(1-b)a, 26, 27, 35 of the Arms Act. The petitioner is languishing in custody for the offences punishable under Section 392 of the I.P.C. and Sections 25(1-b)a, 26, 27, 35 of the Arms Act.

Some unknown miscreants looted away cash of the informant. The learned court below, while refusing prayer for bail, has relied on para 7, 9, 10, 11 and 12 of the case diary. Those paragraphs do not reveal that any witness has claimed to have identified any of the miscreants. Investigation of the case is already complete.

No.3398 of 2021(5) dt.26-07-2021 2/2 Considering lack of sufficient material against the petitioner for further detention as under trial prisoner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with Riga P.S. Case No. 26 of 2020 corresponding to G.R. No. 316 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the trial Court.
