Petitioner seeks bail in Parbatta P.S. Case No.93 of 2019 instituted for the offence under Section(s) 399, 402 Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act. Counsel for the petitioner submits that there is no recovery of firearms from conscious possession of the petitioner.
In the written report, it is alleged that police got information that accused persons of Parbatta P.S. Case No.92 of 2019 were planning to commit crime in the fodder house of the petitioner. Petitioner was arrested while others managed to run away. One knife was recovered from possession of the petitioner. It is further alleged that one pistol was recovered
Patna High Court CR. MISC. No.44250 of 2019(3) dt.02-09-2019 2/2 from the fodder house, which was in abandoned condition. Petitioner is in custody since 27.03.2019.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Parbatta P.S. Case No.93 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
