The petitioner apprehends his arrest in connection with Sona P.S. Case No. 122 of 2015 registered under Sections 147, 148, 149, 341, 323, 325, 307, 427, 504, 506 of the I.P.C. and 27 of the Arms Act pending in the Court of C.J.M., Jamui. The accusation is that the petitioner and others named in the F.I.R. entered in the shop of the informant and caused grievous injury to the informant through iron pipe at his head.
Submission is that there is case and counter case in between the parties. It is also submitted that there is no specific allegation of the assault against the petitioner.
Patna High Court Cr.Misc. No.47349 of 2015 (2) dt.11-02-2016 Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, his prayer for grant of bail is rejected. However, petitioner is directed to surrender before the Court below within a period of four weeks and pray for regular bail, which shall be decided on its own merit without being prejudiced by the present order.
