JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner and the State. Learned counsel for the petitioner submits that the petitioner, Najbun Nesa, does not have any voter identity card or any identity card for proof of age. She, however, has the identity card of her daughter, namely, Hasina Khatoon, from which it would appear that she (petitioner) would be about 70 years of age. The order dated 02.07.2015, passed in Cr. Misc. No. 11246 of 2015 is modified to the extent that the Court below would consider the identity card of her daughter while ascertaining her (petitioner) age.
The modification petition stands disposed of. Let this order be communicated to the Court of Shri C.B. Singh, Judicial Magistrate, 1st Class, Gopalganj, in connection with Gopalpur P.S. case no. 88 of 2014. (Samarendra Pratap Singh, J.) Uday/- U T
