Petitioner apprehends his arrest in connection with Kateya P.S. Case No.113/2019 registered for the offence punishable under Sections 406, 420 and 409 of the Indian Penal Code.
Petitioner happens to be the Manager of Kateya Nagar Parishad and its president, ex-president and ex-manager are said to have defalcated Rs. 12,70,748/- deposited by 16 persons in the PACS.
It is submitted by learned counsel for the petitioner that the petitioner in the capacity of the manager of said PACS distributed the aforesaid amount to 60 persons as loan, who have not returned the loan amount as yet after giving several demand notice and no cooperation is being extended to him by the Block Co-operative Officer or District Co-operative Officer
Patna High Court CR. MISC. No.43743 of 2019(3) dt.11-09-2019 2/2 in recovery of the aforesaid loan amount and no audit report has been furnished in the matter as yet. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The petitioner has no criminal antecedent. On the other hand, learned APP opposed the bail prayer of the petitioner.
In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-XV, Gopalganj in connection with Kateya P.S. Case No.113/2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Prakash Chandra Jaiswal, J) amit/- U T
