The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code.

As per the prosecution case, three unknown accused persons robbed the informant, a Manager in a private finance company, of his belongings including the cash which he was carrying.

It is submitted by learned counsel for the petitioner that the prosecution is mainly relying on the CCTV footage of the occurrence wherein the petitioner was not identified. In the said CCTV footage one Sunil Choudhary was identified who has been enlarged on bail vide order dated 7.1.2022 passed in Cr.Misc. no. 29035 of 2021. Referring to the order of the

No.55316 of 2021(2) dt.05-04-2022 2/2 learned trial Court it is submitted that the name of the petitioner transpired in course of investigation on the statement of the said Sunil Choudhary who has already been enlarged on bail. The petitioner is in custody since 12.6.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case, grant of bail to Sunil Choudhary on whose confessional statement the name of the petitioner transpired together with the petitioner having remained in custody for over 9 months and chargesheet having been submitted in the case without putting the petitioner on T.I. parade, the Court directs the petitioner to be enlarged on bail in connection with Muffasil P.S. Case no. 213 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Katihar.
