KUMAR ORAL ORDER 07-06-2017 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in a case for the offences registered under Sections 452, 341, 323, 307, 504, 506 and 34 of the Indian Penal Code.
Allegation against the petitioner is to have abused and assaulted with fists and slaps. There is also allegation of throwing acid upon the informant for which his right elbow got burn.
It has been contended on behalf of the petitioner that he has got no criminal antecedent. He has falsely been implicated in the present case due to village politics. Both petitioner and informant are own brothers and land dispute is going on between them. As per injury report, injury is simple in nature. A
Patna High Court Cr.Misc. No.22912 of 2017 (2) dt.07-06-2017 2/2 compromise petition has been filed by the informant for restoring sweet relation between the parties before the court below. Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-V, Bhagalpur, in Sanhaulla P.S. Case no. 55 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
