The petitioner seeks bail in Spl. Case No. 2449 of 2019 arising out of Jakkanpur P.S. Case No. 127 of 2019, instituted for the offence under Section(s) 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that 19.2 litres of foreign liquor has been recovered from the house of co-accused Rajesh Kumar, but as per seizure list the said liquor has been recovered from hut of the petitioner.

Petitioner is in custody since 23.5.2019 having clean antecedent.

Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.44589 of 2019(2) dt.23-07-2019 2/2 of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Patna, in connection with Spl. Case No. 2449 of 2019 arising out of Jakkanpur P.S. Case No. 127 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
